USE OF INFORMATION: The information that you provide us through the access, registration, and creation of a User profile on the Site and/or the Platform, and/or email, and/or filling out physical or electronic forms or surveys, in real-time or historical, will be processed and ordered to generate data indicators, which Skydropx may use to take relevant decisions for its business. All the information that is collected will be used for statistical purposes, in a generic and non-personalized manner, and will be associated with the growth, maintenance, and administration of Skydropx, respecting your privacy.
 
These uses include our internal operations and administration, communication with you, and the fulfillment of requests for services and/or products provided by Skydropx, keeping our records updated to respond to your inquiries, as well as improving, developing, enhancing, and providing the services of Skydropx, through its employees, related parties, subsidiaries, or authorized suppliers and/or business partners, establishing adequate measures to limit the use of the information collected from you, only for legal and authorized purposes in accordance with this Notice, as well as with due confidentiality and security measures.

 
Our clients provide Personal Data to SKYDROPX, directly, indirectly, personally, or through its subsidiaries, affiliates, controllers, and/or business allies, through offices, telephone, email, mobile applications, website, WhatsApp, SMS, and/or at the locations of our branches; which may include: 



I. Personal Data we may request from you:

i. Simple Personal Data:

a) From the Sender: Full name, official identification, CURP, address, email, phone number;
b) From the Recipient: Full name, address, email, phone number; and c) From billing: Name of individual or legal entity for invoicing, Federal Taxpayer Registry (RFC) / Tax Identification Number (CIF), email.

ii. Sensitive Financial Personal Data:

a) Payment information: (i) bank account (for payment of services) which may be a credit card, debit card (bank institution, account number, bank code, and branch); or (ii) through the payment engine of [Paypal, STP, CONEKTA, and Mercado Pago, or other that may be added].


Skydropx may also collect your IP (Internet Protocol) address to help diagnose problems with the Skydropx server and to manage the Site and Platform. An IP address is a number that is assigned to your computer when you use the Internet. Your IP address is also used to help identify you within a particular session and to collect general demographic information. Skydropx may use "push" technology through the application that Skydropx uses to send notifications with prior authorization from the User. This communication does not have any access to other functions or information of the equipment with which it connects to the Site. Information may include the URL they come from (whether or not they are on the Site), which URL they subsequently access (whether or not they are on the Site), what browser they are using, as well as pages visited, searches performed, publications, commercial preferences, messages, etc.

II. Use of Cookies


To obtain more information from you, we may use cookies, web beacons, and/or similar technological elements, with which it is possible to monitor your behaviors as an internet user such as: to obtain information, such as type of browser and operating system; internet pages you visit; links you follow; IP address; sites you visited before entering ours; user recognition; detect highlighted information; and measure some traffic parameters. III. Third-Party Data

We understand that the Personal Data of third parties (such as sender and/or recipient data, personal and/or commercial references) that you provide to us, have already been authorized by their owner to be delivered and processed by us in accordance with this PRIVACY NOTICE.

IV. Purposes

i. Primary Purposes:


The primary purposes applicable to the Personal Data (the "Primary Purposes") will be: to identify you as a client or supplier; user of our services, to prepare documents, contracts, agreements, invoices, receipts, and/or documentation related to the relationship; to receive and/or process payments; storage; and to comply with terms and conditions established with you.

ii. Secondary Purposes:


The secondary purposes applicable to the Personal Data (the "Secondary Purposes") will be: marketing and prospecting statistics and reports of the services provided by the Data Controller to maintain internal control of such services, transfer the data to subsidiary, affiliated, and related companies, their third-party service and product providers, for the purpose of offering products and/or services, carrying out prospecting and promotion of goods and services related to the Data Controller's corporate purpose, and any other analogous or compatible purpose with the aforementioned.

V. Security and Confidentiality


Personal Data and their confidentiality are protected by administrative, technical, and/or physical security measures to prevent damage, loss, alteration, destruction, use, access, or improper disclosure. For example, your Personal Data is stored in an internal database, whose administration is through access keys that change periodically and whose access is restricted to authorized persons; confidentiality agreements with their personnel, among others.

VI. Transfer of personal data

The controller or responsible informs the data subject, and the latter accepts, that SKYDROPX may transfer their Personal Data within and outside the country, to fulfill the contracted services, and this transfer may be made to:

 
a) Companies within the same SKYDROPX group;
b) Courier and/or package delivery companies to fulfill what has been contracted by you;
c) Our service providers and subcontractors hired to perform functions on our behalf or provide us with services (such as storage and delivery; marketing and advertising; legal, auditing, accounting, and other professional service providers; and other services related to our business), provided that such service providers do not collect,
use or disclose personal information for any other purpose than to perform such functions on our behalf to provide us with services, or in any other way required by law;
d) Carefully selected third parties, including our affiliates, to send you marketing information and promotions from third parties that may be of interest. In such circumstances, these organizations may be subject to confidentiality obligations and restrictions on the use of your personal information. We will obtain your express permission before allowing a non-affiliated third party to send such marketing and/or promotional information; and
e) Law enforcement agencies, government or regulatory bodies, or other third parties to comply with applicable law.


VII. ARCO RIGHTS

As a client, you have the right to access, rectify, and cancel the treatment of your Personal Data, and to revoke your sent (collectively named as “ARCO right(s)” and in spanish are “Derechos Arco”). To exercise these rights, you must submit a written request for the exercise of ARCO rights addressed to the Accounting Department of SKYDROPX, the data protection controller or responsible party, located at the address indicated above, or communicate via email to derechosarco@skydropx.com (subject on the email “Request”). In both cases, the client will receive an acknowledgement of receipt by SKYDROPX. The Request must contain the following information: your full name; email address for notifications; a simple copy of your official identification with a photograph; a clear and precise description of the Personal Data for which you seek to exercise any of the ARCO rights; a description of any element or document that facilitates the location of your Personal Data; and your signature on the request.

In case of exercising the right of: Rectification, you must indicate the modifications to be made and provide the documentation that supports the request; and Access, SKYDROPX will provide the Personal Data via email and/or by appointment at corporate offices, at SKYDROPX's choice.


Within a maximum period of 20 (twenty) business days, counted from the acknowledgment of receipt of the Request, SKYDROPX will attend it, and reply to you regarding the admissibility of the request by a notification sent to the email address provided. In case your request is deemed admissible, SKYDROPX must make it effective within 15 (fifteen)
business days after the latter notification.


The data subject understands, acknowledges, and accepts that the cancellation and/or opposition to the use of their data generates the impossibility for the Controller or Responsible to exercise the legal relationship that it will hold with the data subject, for the fulfillment of the inherent obligations to its corporate purpose, and others that it may contract
as such.


VIII. EXCLUSION LIST

In addition to the procedure for the exercise of the ARCO Rights, you have the right to ask for an exclusion of those considered as Secondary Purposes, and in consequence, to revoke or express your refusal to processing your Personal Data; and/or be included in the "Exclusion List" enabled and owned by SKYDROPX that allows us to limit the use and disclosure of Personal Data. For both purposes, you just need to send us the request to revoke or be excluded, which must contain: name(s) and surname(s); and an email account to respond to your request, it should be addressed to the Accounting Department of SKYDROPX, responsible for the protection of Personal Data, at the following email address derechosarco@skydropx.com, and receive an acknowledgment of receipt so that SKYDROPX is bound in this regard. The acknowledgment of receipt includes proof of revocation and/or registration in the "Exclusion List". SKYDROPX has a maximum of 5 (five) business days to respond.

 
All documentation must be sent in PDF format, legible, and complete so that SKYDROPX can attend to the Request.

 
In the case of acting through a representative in any of the requests mentioned above, the existence of the representation must be accredited, through a public instrument or power of attorney signed before two witnesses in your case, and also send a simple copy of the official identification of your representative.

XI. AUTHORITIES

If you believe that your right to the protection of Personal Data has been violated by SKYDROPX or you suspect that there has been a violation of the provisions outlined in the Law in the processing of your Personal Data, you may file your complaint or report with the National Institute for Transparency, Access to Information and Personal Data Protection, INAI (www.inai.org.mx), within 15 (fifteen) days following the date you receive SKYDROPX's response or after the 20 (twenty) day period from the date of receipt of the Request to exercise rights has elapsed.


X. CHANGES OR MODIFICATIONS TO THE PRIVACY NOTICE


Important: Any modification to this PRIVACY NOTICE will be made known to you on this same website:

CONSENT OF THE DATA SUBJECT

 
In accordance with Article 8 of the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), I consent to provide my data to the Responsible Party to be treated by what is stated in this Privacy Notice that was made available to me.

 
Likewise, based on the second paragraph of Article 36 of the aforementioned law, I accept the transfer of my personal data to third parties that are necessary for accordance with numeral VI (six) of this Privacy Notice.

 
By browsing the website, it is understood that the Data Subject has read and agrees to the terms and conditions of the processing of their personal data.

 

XI. DIGITAL, ELECTRONIC, OR ONLINE FORM


The Parties agree that the means to perfect the agreement of wills between them may be in Digital, Electronic, or Online format, where it will suffice to express their will using their acceptance, as well as provide personal data, on the Skydropx website without requiring any signature to be affixed to any document.
